Fundamental rights of gender-based violence victims in priority attention groups within the context of the international human rights system

Abstract

Gender-based violence constitutes a social and structural problem that disproportionately affects vulnerable groups, including the Deaf community. The objective of this study was to analyze the social, communicational, cultural, and institutional barriers faced by Deaf women in contexts of gender-based violence, from a human rights and intersectional perspective. To this end, a qualitative and interpretative research approach was developed to understand how inequalities related to gender, disability, and communication limit access to protection and the effective exercise of their rights. The findings revealed that Deaf women face multiple forms of exclusion resulting from a lack of accessibility, the limited availability of sign language interpreters, and insufficient institutional preparedness to address situations of gender-based violence. Furthermore, communicational barriers were identified as contributing factors to the invisibilization of violence and as obstacles to both reporting abuse and accessing protection and justice mechanisms. In conclusion, the study highlights the need to strengthen inclusive, accessible, and culturally appropriate public policies that guarantee substantive equality and the comprehensive protection of the rights of Deaf women facing gender-based violence.
